Birmingham City Council (the "Council") wishes to establish a Light Touch Open Procedure for the provision of home support for adults at approved premises and at HM Prison Birmingham. The Care Act became law in June 2014; Section 76 of the Act sets out the responsibilities for the provision of care and support for adult prisoners. Where it appears that adults in prison have needs for care and support, they should have their needs assessed by the local authority and where they meet eligibility criteria; have services provided by the local authority. In essence prisoners are entitled to receive the same access and provision of services as if they were a member of the local community. Approved Premises are residential facilities that provide supervision and support for high-risk offenders released from custody, acting as a bridge between prison and community life. The referral processes for social care will be in place from the start of the contract and individuals will also have the right to self-refer.
